1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Faimora Interiors (“we,” “us,” or “our”), concerning your access to and use of the https://faimora.com website as well as any other media form, media channel, mobile website, or related, linked, or otherwise connected thereto (collectively, the “Site”).
By accessing the Site and using our services, you confirm that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. Description of Services
Faimora Interiors provides interior design consultation, architectural visualization, 3D modeling, and rendering services (“Services”).
Important Limitation: You explicitly acknowledge that Faimora Interiors acts solely as a design consultant. We are not licensed architects, structural engineers, or general contractors. Our deliverables (renderings, floor plans, and mood boards) are conceptual in nature and intended for visualization purposes only. They are not intended to be used as architectural or engineering construction documents. You are responsible for hiring licensed professionals to review and implement any designs.
3. Intellectual Property Rights
Unless otherwise indicated, the Site and the Services are our proprietary property.
Ownership: All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.
Client Deliverables: Upon full payment of all fees, Faimora Interiors grants you a non-exclusive, non-transferable, perpetual license to use the final designs and renderings for your personal or specific commercial project. However, Faimora Interiors retains the underlying intellectual property rights and the right to use the designs and renderings for our own marketing, portfolio, and promotional purposes.
Restrictions: You may not reproduce, distribute, sell, license, or otherwise exploit any Content or deliverables for any commercial purpose (e.g., reselling our 3D models) without our express prior written permission.
4. User Representations
By using the Site or our Services, you represent and warrant that:
All registration information you submit will be true, accurate, current, and complete.
You have the legal capacity and you agree to comply with these Terms of Service.
You are not a minor in the jurisdiction in which you reside.
You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
Your use of the Site will not violate any applicable law or regulation.
5. Payment and Billing
Fees: Pricing for our services is described in your specific project proposal or invoice. All prices are in US Dollars.
Deposits: We typically require a non-refundable deposit before work commences.
Late Payments: We reserve the right to suspend or terminate work if payments are not made in accordance with the agreed schedule.
Taxes: You agree to pay all applicable taxes associated with your use of the Services.
6. Third-Party Websites and Content
The Site may contain links to third-party websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”).
We are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us.
7. Limitation of Liability
To the fullest extent permitted by law, in no event will Faimora Interiors, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages.
This includes, but is not limited to:
Construction Errors: Damages resulting from the implementation of our designs by third-party contractors.
Product Issues: Damages resulting from furniture or materials selected based on our recommendations that are defective, unavailable, or incorrect.
Data Loss: Loss of data or profits arising from your use of the Site.
8. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) breach of these Terms of Service; (3) your violation of the rights of a third party, including but not limited to intellectual property rights; or (4) any overt harmful act toward any other user of the Site with whom you connected via the Site.
9. Governing Law
These Terms shall be governed by and defined following the laws of the State of California. Faimora Interiors and yourself irrevocably consent that the courts of California shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
10. Modifications to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Service, and you waive any right to receive specific notice of each such change.
